Last year, the Massachusetts legislature passed an expansion to the state’s pay equity laws, which was later signed into law by Governor Maura Healey. The new law requires businesses with more than twenty-five workers to include a salary range in job postings and mandates data reporting for businesses with over one hundred employees. While some business groups supported this legislation, NFIB consistently opposed it as "more needlessly imposed government red tape."

The reporting requirement compels businesses with one hundred or more employees to submit their EEO-1 Report to the Commonwealth and the Employment Opportunity Center by February 1, 2025. For additional information and submission details, individuals are directed to visit the state’s website: Workforce Data Reporting FAQs | Mass.gov.

The collected data will be aggregated to ensure no individual business's information is made public. Furthermore, the provision regarding salary ranges for job listings will take effect on October 29, 2025.
