Massachusetts remains one of only two states in the U.S. that prohibits businesses from imposing a surcharge on customers using credit cards. This restriction is reportedly costing businesses in the state significant amounts as swipe fees continue to increase.
The National Federation of Independent Business (NFIB) has voiced support for several legislative bills aimed at lifting this prohibition. These bills would enable businesses to charge a convenience fee for customers choosing to pay with credit cards.
Some proposed bills mandate business owners to display signage and provide a detailed breakdown of the fee on receipts, informing customers about the surcharge. Other proposals suggest removing the relevant legal section entirely. The NFIB sees these measures as beneficial steps toward helping small businesses offset the rising costs associated with credit card swipe fees.
