Florida man pleads guilty in Medicare kickback conspiracy involving medical equipment

A Florida resident has admitted to participating in a scheme that violated federal anti-kickback laws related to Medicare billing for durable medical equipment. Deane Gilmore, 35, of Brandon, Florida, pleaded guilty on January 28 before U.S. District Court Judge Brian E. Murphy to one count of conspiracy to pay and receive kickbacks. Sentencing is scheduled for May 12, 2026.

According to federal prosecutors, from March 2020 through April 2022, Gilmore owned and managed two companies—Jupiter Medical Associates Inc. and Granite Medical Associates Inc.—that paid telemarketers or call centers to obtain medical information from Medicare beneficiaries. These intermediaries then prepared orders for items such as back, knee, wrist, or ankle braces. The documentation made it appear that medical practitioners had properly prescribed the equipment when in many cases the orders were not medically necessary and relied on false records.

Gilmore compensated these telemarketers on a per-order basis, which is prohibited by the Anti-Kickback Statute. Prosecutors say he submitted or caused the submission of about $6.5 million in claims tainted by kickbacks to Medicare; approximately $2.3 million was ultimately paid out by the program.

The charge carries a potential sentence of up to five years in prison, three years of supervised release, and a fine up to $250,000 or twice the financial gain or loss involved in the offense.
