A Brazilian national living unlawfully in Weymouth has been indicted for reentering the United States after deportation. Josimar Fernandes-Pessoa, 38, faces one count of unlawful reentry of a deported alien.

The indictment states that Fernandes-Pessoa was removed from the U.S. in 2019 after being apprehended near the U.S.-Mexico border in Texas. Before his removal, he pleaded guilty to improper entry by an alien in the Western District of Texas. It is alleged that he reentered the U.S. illegally sometime after his 2019 removal.

The charge carries a potential sentence of up to two years in prison, one year of supervised release, and a fine up to $250,000. The defendant may be deported again upon completing any imposed sentence. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and relevant statutes.

United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston announced the indictment. Assistant U.S. Attorney David Cutshall is prosecuting the case.

It is important to note that these details are allegations, and Fernandes-Pessoa is presumed innocent until proven guilty beyond a reasonable doubt in court.
