A Brazilian national residing unlawfully in Framingham has been indicted for illegally reentering the United States after deportation. Joelson Gomes Fonseca, aged 39, faces one count of unlawful reentry of a deported alien.
The charging documents reveal that Fonseca was previously deported in March 2008 following a conviction for an aggravated felony. The charge carries a potential sentence of up to 20 years in prison, three years of supervised release, and a fine reaching $250,000. Deportation is mandated upon completion of any imposed sentence. Sentences are determined by a federal district court judge based on U.S. Sentencing Guidelines and applicable statutes.
United States Attorney Leah B. Foley and Patricia H. Hyde, Field Office Director of U.S. Immigration and Customs Enforcement’s Enforcement and Removal Operations in Boston, announced the charges. First Assistant U.S. Attorney Katherine Ferguson is leading the prosecution.
It is important to note that the details within the charging documents are allegations at this stage, and Fonseca is presumed innocent until proven guilty beyond a reasonable doubt in court.
